COMPETITION COMMISSION SEEKS LEAVE TO APPEAL COMPETITION APPEAL COURT RULING
ON POLYMER PRICING

On 17 June 2015, the Competition Appeal Court (“CAC”) delivered its
judgement and ordered that the decision of the Competition Tribunal against
Sasol Chemical Industries Limited’s (now Sasol South Africa (Pty) Limited)
(“Sasol”) pricing of propylene and polypropylene be set aside and that
Sasol’s appeal be upheld.

On 8 July 2015, the Competition Commission served notice to the CAC, in
terms of which it is seeking the CAC’s leave to appeal its judgment and
order before the Constitutional Court. On 9 July 2015, the Judge President
of the CAC advised the Competition Commission that it should approach the
Constitutional Court directly on the appeal it seeks to bring.
